OFFICIAL RULES AND REGULATIONS

Park City Summit County Arts Council (PCSC Arts Council) headquartered in Park City, Utah (PO Box 4455 Park City, Utah 84060) is organizing a free game named The Art Lover Sweepstakes (the “#artloversweeps”) on its Facebook and Instagram pages.

Participation in the Sweepstakes evidences that participants accept the provisions of these Official Rules and Regulations. Any participant who does not accept the provisions of these Official Rules and Regulations or who acts in a fraudulent or unfair manner (to be determined at the sole discretion of PCSC Arts Council) may be excluded from the Sweepstakes at any time.

Sweepstakes Period

The Sweepstakes will begin at 12:01 a.m. on Thursday, January 18th, 2018, and will end at 11:59 p.m. on Thursday, January 25th, 2018 (the "Sweepstakes Period"). Any entries entered and/or received after the closing time and date will not be considered. One winner will be chosen daily during the Sweepstakes Period.

Conditions of Participation

Participation in the Sweepstakes is free and no purchase is necessary to enter or win.

Each Participant is allowed to enter as many times as they like (“Entry”) during the Sweepstakes Period. The Sweepstakes is not open to anyone who does not meet the conditions referred to above or to directors, executives and staff of PCSC Arts Council, Blakeslee West Advertising LLC or of any company that is under its control, or that controls it or to anyone involved in the implementation and promotion of the prize drawing and/or the Sweepstakes. PCSC Arts Council reserves the right to request that all Participants provide proof they meet all of these Conditions of Participation. Anyone failing to meet the Conditions of Participation or refusing to provide proof thereof will be excluded from the Sweepstakes and may not claim the prize in the event that she/he wins.

In order to participate, the Participants must have access to the internet and have a valid Facebook or Instagram account. Participants must be a current “follower” of Park City Summit County Arts Council Facebook page and/or Instagram account.

How to Participate

Participants may only enter the Sweepstakes by submitting all required information, in accordance with instructions at the time of entry. By submitting an Entry, the Participant expressly and fully accepts all the provision of these Official Rules and Regulations.

Information the Participant provides with his or her Entry, including identity is binding for the Participant. Any false information will lead to disqualification. Moreover, any Entry which does not comply with these Official Rules and Regulations may be invalidated by PCSC Arts Council at its sole discretion.

Privacy

By entering the Sweepstakes, Participants are agreeing to the collection, use and disclosure of their personal information for the purposes of administering the Sweepstakes. PCSC Arts Council will not sell, trade, rent, or loan this personal information to any other organizations. PCSC Arts Council will protect the entrant’s Personal Information in a manner that is consistent with their Privacy Policy. All entrants give PCSC Arts Council the right to use their name for contact and marketing purposes.

Any Participant has the right to restrict access and remove or correct information provided by the Participant during the term of the #artloversweeps.

Prize

The Prize is the Art Lovers t-shirt from the Capsule Collaborative by PCSC Arts X Zenzee (retail value $50). One winner is chosen daily during the Sweepstakes Period.  The Prize will be mailed via standard USPS shipping and shipping costs are covered by PCSC Arts Council.

The Prize Winner is solely responsible for the reporting and payment of any applicable taxes on the Prize. The Prize Winner may waive his or her right to receive the Prize. The Prize has no cash value, and must be accepted by the Prize Winner as awarded, unless the Prize Winner waives his or her right to receive the Prize.

The Prize may not be exchanged for its cash value, and may not be substituted. If, due to circumstances beyond its control, PCSC Arts Council is not able to provide the stated Prizes, it reserves the right to replace it with another prize of equal or greater value.

Prize Winner Selection

The prize winners shall be randomly selected daily from all entries received that day during the Sweepstakes Period using a “Random Sequence Generator” to ensure fairness. In the event that the Prize Winner waives his or her right to receive the Prize or is ineligible to receive the Prize, an alternate Prize Winner shall be selected randomly from the remaining Entries.

Redeeming the Prize

The Prize Winner will then be contacted by private message on Facebook or Instagram no later than Friday, February 2, 2018. Upon notification, the Prize Winners must respond to the post or private message with a contact number or mailing address within seven (7) days. If the Prize Winner does not respond in accordance with Official Rules and Regulations and does not give all the required information as detailed hereafter, he or she will be considered as having waived the Prize and the Prize will be awarded to an alternate Prize Winner.

The Prize Winner must be in full compliance with the Conditions of Participation described above and the other conditions described in these Rules and Regulations. In addition, all information provided by the Prize Winner must be accurate as provided. Failure to comply with the Conditions of Participation described above and the other conditions described in these Rules and Regulations will lead to disqualification, such failure to be determined at the sole discretion of PCSC Arts Council, and the selection of an alternate Prize Winner.

The Prize Winner acknowledges the right of PCSC Arts Council and its agents to publish (in print or online) the Prize Winner's name and statements without charge or further compensation other than the Prize.

Release and Liability

By entering the Sweepstakes, Participants release PCSC Arts Council and its affiliates, sponsors, advertising and promotion agencies and the immediate family and household members of the above, and each of its affiliated companies, directors, officers, employees, representatives and agents from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the sweepstakes or with the acceptance, possession, or use of any Prize.

PCSC Arts Council reserves the right in its sole discretion to cancel or suspend the Sweepstakes should causes beyond the control of PCSC Arts Council corrupt the administration, security, fairness, integrity or proper conduct of the Sweepstakes.

PCSC Arts Council assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction to or unauthorized alteration of the Entries. PCSC Arts Council is not responsible for (i) any problems or technical malfunctions or any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software; (ii) the failure of any Entry to be received by PCSC Arts Council on account of technical problems or traffic congestion on the Internet or at any web site; or (iii) any combination thereof.

In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and Regulation and disclosures or other statements contained in any Sweepstakes- related materials, including but not limited to the Sweepstakes entry form, or point of sale, print or online advertising, the terms and conditions of the Sweepstakes Rules shall prevail, govern and control.

Complaints, Disputes and Interpretation

PCSC Arts Council is entitled to administer the Sweepstakes as it deems appropriate within the laws applicable to the Sweepstakes. The Sweepstakes and these Official Rules and Regulations have been drawn up and interpreted pursuant to applicable federal, state, and local laws. If one or more provisions of these Official Rules and Regulations are declared void or inapplicable, the others shall retain their force and scope. These Official Rules and Regulations are subject to change without notice in order to comply with any applicable federal, state, or local laws or the policy of any other authority having jurisdiction over PCSC Arts Council.

Any dispute, complaint or disagreement relating to the #artloversweeps, the Prize draw, or these Official Rules and Regulations shall be governed by the laws of the State of Utah, and these Official Rules and Regulations shall be interpreted in accordance with the laws of the State of Utah. Any litigation related to the Sweepstakes must be brought in Utah Third District Court for Summit County. In the event of any litigation related to the Sweepstakes, the prevailing party or parties shall be entitled to recover from the other party all attorneys’ fees and costs incurred in relation to such litigation, whether incurred prior to, during or after litigation.
